Timely Energy provides growth operations consulting, marketing automation, CRM setup, pipeline automation, lead routing, no-code workflow automation, martech stack optimization, and related advisory services. All services are delivered on a professional, best-effort basis. Timely Energy does not guarantee specific business outcomes, revenue results, or performance metrics, as results depend on multiple external and internal factors beyond our control.

Client Responsibilities

Clients agree to provide accurate, complete, and timely information, including access to relevant platforms, tools, and accounts required for service delivery. Delays, inaccuracies, or restricted access may impact timelines and results. Timely Energy is not responsible for service limitations caused by incomplete data, third-party tool restrictions, or client-side delays.

Payment Terms and Billing

All pricing, fees, and payment schedules are agreed upon before services begin. Payments must be made according to the agreed terms stated in invoices or service agreements. Failure to make timely payments may result in suspension or termination of services. All fees are non-refundable unless otherwise specified in writing.

Intellectual Property Rights

All systems, workflows, documentation, strategies, and materials developed by Timely Energy remain its intellectual property unless otherwise agreed in writing. Clients are granted a limited, non-exclusive, non-transferable license to use deliverables solely for internal business purposes. Unauthorized reproduction or distribution is strictly prohibited.

Confidentiality

Timely Energy and its clients agree to keep all non-public, confidential, or proprietary information secure and private. Client data will not be disclosed to third parties except where required by law or with explicit consent. This confidentiality obligation survives the termination of services.

Third-Party Tools and Platforms

Services may involve integration with third-party software, platforms, or tools. Timely Energy is not responsible for outages, updates, pricing changes, security issues, or performance limitations of third-party services. Use of such tools is subject to their respective terms and policies.

Limitation of Liability

To the maximum extent permitted under California law, Timely Energy shall not be liable for indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities. Total liability, if any, shall not exceed the fees paid by the client in the three months preceding the claim.

Termination

Either party may terminate services with reasonable written notice, subject to the terms of any active agreement. Outstanding payments become immediately due upon termination. Timely Energy reserves the right to terminate services without notice in cases of non-payment, misuse, or breach of these terms.

Disclaimer of Warranties

All services and website content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement.

Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of California. Any disputes shall fall under the exclusive jurisdiction of California courts.

Changes to These Terms

Timely Energy reserves the right to update or modify these Terms and Conditions at any time. Continued use of the website or services after updates constitutes acceptance of the revised terms.
